For years we've debunked various entertainment industry studies claiming ridiculous job and economic "losses" from copyright infringement. These studies tend to have all sorts of problems; ignoring the ability to adapt and to introduce new business models, using "ripple effects" in just one direction to double, triple and quadruple count the same "losses" over and over again, and counting every download as a "lost sale." The ripple effects one is especially pernicious because the industry likes to pretend that the impacts of infringement only go in one direction. They ignore that the money not spent on such content doesn't disappear from the economy but can be used elsewhere -- perhaps in areas that provide greater economic growth.



A few years ago, the folks at CCIA smartly took the copyright industry's exact methodology and showed that for all the claims of how much copyright contributed to the economy, exceptions to copyright contributed even more. While the copyright maximalists totally missed the point and attacked the methodology -- not realizing that, in doing so, they had undermined their own methodology -- the point was made. If you believe the claims from the copyright industry, then you also have to believe that the exceptions are more important. The methodology is the same, so either neither are right or both are right.



It looks like Rick Falkvinge, of The Pirate Party, has now done something similar on the "job loss" side of things, and concluded that, using similar methodology to the industry reports, for every job "lost" by copyright infringement, the positive ripple effects in the other direction mean that 11.8 new jobs are created. So if we accept the claim that 1.2 million jobs can be lost due to infringement, it would mean that a separate 14.2 million jobs were created elsewhere.



The report broke down the "creative industry," by noting that (contrary to copyright maximalist claims), most of that industry doesn't actually rely on copyright to make money. In fact, certain "creative" industries could be seen as "copyright-inhibited." For example, advertising. As we constantly hear from copyright maximalists, various sites are making big bucks by using advertising in association with file sharing. So based on the industry's own argument, it seems that the advertising market is clearly copyright-inhibited, and it would grow if there was greater infringement. After going through the numbers, it was determined that the majority of GDP, by quite a bit, are likely in the "copyright-inhibited" arena.



Now, you can certainly argue with the methodology here. I don't think anyone actually believes these numbers are accurate. But it's using the same basic methodology, assumptions and thought processes behind the studies in the other direction. You can also, obviously, claim that Falkvinge is biased. He is. But is he more biased than the entertainment industry legacy players who do the other studies? It seems clear that the industries are likely to be more biased, since they have billions of dollars bet on keeping the old structures in place. I think both studies are probably far from accurate in all sorts of ways, but if you're going to cite the entertainment industry's claims based on this kind of methodology, it seems you should also have to accept these claims. Not doing so suggests serious cognitive dissonance or someone who is paid not to believe the truth.

Skype said it is almost wholly reliant on SkypeOut revenue, which made up 86 percent of its $860 million in revenue last year, according to its updated S-1 filing. Skype knows it needs to diversify its revenue if it wants to grow and have the money to invest in new features, and it needs the money to keep Skype-to-Skype calls free. By tapping advertising as a new revenue stream, it can ease its over-reliance on SkypeOut, which the company identified as a risk factor.


Skype recently announced it has hit 29 million concurrent users, and said in its S-1 that its overall user base is up to 663 million. It has a lot of people communicating, increasingly through video, which makes up 42 percent of calls. It’s an expensive setup, but it’s also a great opportunity for advertising. Rogers had a legitimate beef. The California bank had doubled his insurance costs, putting him in a policy that had him carrying $1 million of insurance on a property he bought for $180,000 in 2002. Note that this looks an awful lot like a forced place insurance scam; servicers find creative ways to overcharge for insurance and then get kickbacks.


When the bank refused to answer questions about the charges, including ones sent in writing, Rogers looked into ways to force the bank to respond. As the Consumerist explains:


Patrick boned up and learned about a law called the Real Estate Settlement Procedures Act (RESPA). The law was enacted to safeguard homebuyers from anti-competitive and collusive behavior among the companies and agents involved with buying and selling real estate. One of the protections involves the “Qualified Written Request,” or QWR.


The Qualified Written Request is a specific kind of letter that you can send to your mortgage servicer when you believe there is an error on your mortgage account. You have to make sure to follow the rules for formatting it, but the servicer is bound by federal law to respond within a certain period of time. If they don’t, you can go after them for actual damages, costs and attorneys fees, plus $1000 of additional damages if there is a pattern of noncompliance.


“Do your research,” says Patrick. When drafting it, besides getting tips on writing one from various consumer sites, he also went to banking sites and saw how bankers were talking about ways they had rejected various QWRs. He made sure to craft his so it couldn’t get disqualified. “Use the internet as your law library,” says Patrick. With a little Googling, he was quickly about to find official resources and templates that guided him, step by step.

They must also give a name and phone number for the borrower to contact with questions about their account.


Wells Fargo did none of these, says Patrick. So he moved on to the next step provided by RESPA: statutory damages, aka, cash money.


Even though legal fees would be covered under RESPA, the amount at issue was too little to interest attorneys, so Rogers filed a claim against Wells in small claims court. Most cases in small claims courts are pro se, meaning the parties to the suit argue their own cases. No one from Wells appeared, so Rogers got a default judgment for $1,173. Even though Wells did send payment, they still refused to respond to his letters or reduce his premiums, as the statute required. Again per Consumerist:


So he filed for a sheriff’s levy. This directs the sheriff to seize and sell the debtor’s property to pay up. In this case, it was the local branch office of Wells Fargo mortgage, the ones who had been ignoring him all these years.


To get the levy, he presented the court clerk with his default judgment and got the Writ of Execution and the Instructions for Levy which he delivered to the sheriff’s office. He paid them a $50 deposit to cover their administrative costs. A local sheriff then went into the Wells Fargo branch office and took an inventory and posted notice that nothing could be removed. The court also gave him several posters which he was expected to xerox and post around town.


The article is a bit unclear, so I assume the default judgment included the requirement that Wells respond to the information request and lower the insurance premium.


The two parties appear finally to be working towards a resolution. And notice how he was shrewd enough to invest the time to draft a proper QWR; most people would have grabbed the first template they found on line and used that (and given that bank sites discuss how to reject QWRs, one has to wonder if at least some of these deficient models are bank plants).


So this route isn’t for everyone. But could it be? For instance, mortgage counselors work regularly with borrowers under stress. It would not take much effort for a the legal aid program of a local law school to come up with proper models for effective letters under RESPA. The school or the mortgage counselors could also give advice on follow-up steps on the course of action in the likely event that the bank did not reply.


If some groups got together to make these letters and strategies more accessible to ordinary borrowers, they could be used to enforce the law’s intent, namely, that banks treat borrowers fairly.


Now this may seem funny, but it is actually pathetic that someone had to go to this length for a bank to straighten out an “error” that may in fact be an institutionalized abuse.





In Part I of this series we discussed the media's failure to accurately report the scope and nature of the banker crime wave around foreclosure fraud, and talked about the confusion over reports that the Administration has proposed a framework for settling the fifty-state lawsuit against the banks. (Hmm ... wonder why there wasn't a Federal lawsuit, too?)


Is there really an Administration proposal for a deal? Given the number of reports and the absence of denials from the White House, the answer appears to be ... sort of. It seems clear that the Administration's proposing to create a $20 billion fund at the banks' expense which would be used to help underwater homeowners, and that the banks would administer this fund themselves (we'll respond to the proposal outline in Part III of this series). But even that's not 100% certain, since reports suggest that there's still infighting among government agencies.


Reuters reports that the Consumer Financial Protection Bureau (CFPB) and Federal Deposit Insurance Corporation (FDIC) folks are pushing for a larger settlement, but that the Office of Comptroller of the Currency (OCC) thinks the proposed settlement is already too big. All of this alphabet soup is beginning to spell out a slang expression that describes the government's handling of this situation with pinpoint accuracy. That expression begins with "cluster" and ends with the word Melissa Leo introduced to the Academy Awards last Sunday night.


The virtual ink was barely dry on the initial reports of an Administration proposal when Reuters reported that "regulators' efforts to settle with banks over improper mortgage foreclosures are being hampered by disagreements among the groups involved over the size and shape of an accord." Other stories then elaborated on the squabbles among Federal agencies over the scope and nature of the proposed settlement. It seems as if everybody in the Federal government is running to the press so they can put their own spin on a proposed deal.


It looks like we're observing a serious vacuum in leadership during a time of crisis. This vacuum, together with the confusion that's been created in the press as everybody pushed their own agenda, has left the public becalmed in fog-shrouded waters somewhere between Conflicting Viewpoints, Absolute Bewilderment, and WTF.


(Hey, you know what would be great? It would be great if all of these Federal agencies reported to a single person - and that person was empowered to make an executive decision on behalf of the entire executive branch of government. You could call that person the "Chief Executive," or ... but I digress.)


Despite all the confusion, the outlines of the Administration's proposal seem to be coalescing around three main provisions: Banks would have to write down the principal on underwater mortgages with $20 billion of their own money (investors in mortgage-backed securities and other instruments would not be held responsible), and they would implement their own mortgage modification programs. No government money would be used to reduce principal.


Any proposal from the Federal government would have to be accepted by the states before being presented to the banks. Based on what we've learned so far, does this proposal provide the right framework for a comprehensive settlement? We'll save our conclusion for the third and final installment of this series, but here's a sneak preview:

App Store Classics: Game Dev Story, a game about making games.


Ever wondered what it’d be like to run your own game development house? Me neither, but don’t let that stop you getting involved with Game Dev Story (iTunes link), a little gem of a game from Japanese developers Kairosoft, currently on sale in the app store for $0.99.


The concept is straightforward – grow your development house from a tiny team of four staff churning out cheap and cheerful PC games to a revered coding powerhouse in swanky offices crafting masterpieces for the latest consoles.


At first you’ll probably be going over budget left right and centre, trying to figure out which game types work best and therefore shift more units, but once you get into the swing of it you can concentrate on hiring and training the best staff and purchasing licences to develop console games, resulting in better made and better selling games with higher profit margins.


It’s not just a question of hiring and firing, coming up with game ideas and watching your staff working their buns off though. Through the use of ‘boosts’ which are periodically made available to purchase as the game progresses (not in-app purchases I hasten to add), you can choose one of your coders to work on enhancing one specific aspect of the game. This pushes up the overall quality of the game you’re making and results in better reviews and sales, adding a further strategic element as you choose the right moment and category in which to use your boosts. At certain points within the development cycle you also get the chance to work on the graphics and sound specifically, either using one of your own staff or hiring in a freelancer, and this too gives you the opportunity to increase the overall quality of your virtual product.



When you make your first million seller it’s a satisfying moment but there’s no time to rest on your laurels. There are always new consoles appearing on the market, contract jobs to take on, new staff to hire and new game types to discover. If you leave too much of a gap between development cycles you start losing fans and therefore a few sales, but think carefully about what kind of games you make – my pirate simulation was a right turkey.



It’s all great fun, but it’s fair to say there are a few things here which need to be addressed by the time Game Dev Story 2 arrives in the app store. I know it’s a tall order on a phone but I couldn’t help thinking how nice it would be if I could play the games my team had made. Even a comedy cut sequence showing some aspects of the latest game would have been good. There are also some hugely expensive advertising options within this game that offer no feedback other than some numbers increasing on a stat page. If I’m sponsoring a racing team I’d like to see my company logo on the side of a formula one car at least!


Finally, the game is perhaps a bit on the easy side. I’m sure if developing a multi million selling game was this straightforward we’d all be at it. Well, maybe not, but it’s easy to make enough money that you don’t have to worry too much about how you spend it, and this negatively impacts the strategy element.


All things considered however, Game Dev Story is great fun. It’s a good natured game and from the cute graphics and retro sound to the amusing titles you can give your creations, it’s a rewarding experience which works perfectly whether in short bursts or longer play sessions. Did I mention that it’s currently only $0.99 on the app store?

Last we heard in October, the Department of Justice had prepared a flurry of subpoenas to delve into the handling of campaign finances in John Edwards’ presidential run, with a specific eye towards the use of some funds to keep the Rielle Hunter scandal under wraps.  Today, the Associated Press reports that the grand jury has targeted Edwards in its probe, and not just Edwards.  Subpoenas have been issued for Alliance For a New America (AFNA) and linked organizations, where millions of dollars got spent with no public accounting:



A federal criminal investigation targeting John Edwards is examining how much the two-time presidential candidate knew about money used to cover up his extramarital affair and out-of-wedlock child and whether he had other practices that pushed the bounds of campaign finance laws, people involved in the case have told The Associated Press.


A federal grand jury meeting in Raleigh, N.C., is combing through records and testimony involving several political organizations and individuals connected to Edwards and trying to determine if the former North Carolina senator and 2004 vice presidential nominee broke any laws. A recently issued subpoena focuses on a web of these political groups allied with Edwards, according to subpoena details provided to AP that offer a glimpse into the investigation being conducted behind closed doors.



The situation gets murky indeed when looking at AFNA:



Atop the subpoena list, read to the AP by someone with access to a subpoena, is the Alliance for a New America, which is what is known as a political 527 group, named for the tax code section that governs it. Also on the list is a like-named private entity called Alliance for a New America LLC, or AFNA LLC, and Edwards’ former campaign manager Nick Baldick, who ran the political 527 group in support of Edwards’ bid for the 2008 Democratic presidential nomination. (IRS records for the same groups refer to the groups as Alliance for New America, without an “a.”)


Baldick and his attorney Jim Lamb would not comment on the federal investigation, but Lamb said Baldick has been told he is not a target of it.


Federal records show that about $3.3 million of the $4.8 million raised by the 527 was distributed to AFNA LLC for unspecified “consulting services.” The 527 and the LLC shared not only their name, but the same Alexandria, Va., post office box and the same contact, a Baldick associate named Katherine Buchanan. A crucial difference between the two Alliance entities was that the LLC was a limited liability company that did not have to publicly disclose how its money was spent.



The question will be whether that distinction was legal on its face, or whether it was used as a dodge to funnel money illegally to Edwards for his own personal use.  If the grand jury can connect the expenditures on “consultants” to those who tried keeping the lid on Edwards’ relationship with Hunter, the legality of the edifice may be a moot point anyway.  Presumably, the grand jury and the investigators are looking for someone on the inside to testify to how the money got spent. If they do and the money got directed to hide Hunter and keep her quiet, then everyone involved may face conspiracy charges.


AFNA isn’t the only entity under scrutiny, either.  The One American Committee paid Hunter over $100,000 for campaign Internet videos that never got published.  They also want to see how massive contributions from Fred Baron and Bunny Mellon were distributed, the latter of which got hidden in boxes of chocolates according to former aide Andrew Young’s book with the express purpose of keeping Hunter quiet.  Baron claimed to have supported Hunter financially without Edwards’ knowledge, but Young’s book says that Edwards agreed to hit up Mellon for hush money, which the grand jury seems to think may be an interesting avenue of inquiry.


None of this means anything until the grand jury produces indictments, of course — but becoming a target of a grand jury is the one way that happens.






Last we heard in October, the Department of Justice had prepared a flurry of subpoenas to delve into the handling of campaign finances in John Edwards’ presidential run, with a specific eye towards the use of some funds to keep the Rielle Hunter scandal under wraps.  Today, the Associated Press reports that the grand jury has targeted Edwards in its probe, and not just Edwards.  Subpoenas have been issued for Alliance For a New America (AFNA) and linked organizations, where millions of dollars got spent with no public accounting:



A federal criminal investigation targeting John Edwards is examining how much the two-time presidential candidate knew about money used to cover up his extramarital affair and out-of-wedlock child and whether he had other practices that pushed the bounds of campaign finance laws, people involved in the case have told The Associated Press.


A federal grand jury meeting in Raleigh, N.C., is combing through records and testimony involving several political organizations and individuals connected to Edwards and trying to determine if the former North Carolina senator and 2004 vice presidential nominee broke any laws. A recently issued subpoena focuses on a web of these political groups allied with Edwards, according to subpoena details provided to AP that offer a glimpse into the investigation being conducted behind closed doors.



The situation gets murky indeed when looking at AFNA:



Atop the subpoena list, read to the AP by someone with access to a subpoena, is the Alliance for a New America, which is what is known as a political 527 group, named for the tax code section that governs it. Also on the list is a like-named private entity called Alliance for a New America LLC, or AFNA LLC, and Edwards’ former campaign manager Nick Baldick, who ran the political 527 group in support of Edwards’ bid for the 2008 Democratic presidential nomination. (IRS records for the same groups refer to the groups as Alliance for New America, without an “a.”)


Baldick and his attorney Jim Lamb would not comment on the federal investigation, but Lamb said Baldick has been told he is not a target of it.


Federal records show that about $3.3 million of the $4.8 million raised by the 527 was distributed to AFNA LLC for unspecified “consulting services.” The 527 and the LLC shared not only their name, but the same Alexandria, Va., post office box and the same contact, a Baldick associate named Katherine Buchanan. A crucial difference between the two Alliance entities was that the LLC was a limited liability company that did not have to publicly disclose how its money was spent.



The question will be whether that distinction was legal on its face, or whether it was used as a dodge to funnel money illegally to Edwards for his own personal use.  If the grand jury can connect the expenditures on “consultants” to those who tried keeping the lid on Edwards’ relationship with Hunter, the legality of the edifice may be a moot point anyway.  Presumably, the grand jury and the investigators are looking for someone on the inside to testify to how the money got spent. If they do and the money got directed to hide Hunter and keep her quiet, then everyone involved may face conspiracy charges.
